In a ruling on account fees, the Federal Court of Justice has clearly ruled in favor of customers. Banks that introduce or increase fees if customers do not object to the general terms and conditions are acting unlawfully. The decisive factor is which fees were contractually agreed when the account was opened. Any subsequent increase without express consent is invalid. Customers can therefore reclaim fees retroactively back to 2018.
